Disclaimer

Effective Date: 1 July 2025  ·  Last Updated: 1 July 2025

1. Medical & Clinical Disclaimer

Dritiva is not a healthcare provider, medical device manufacturer, or clinical research organisation (CRO). Nothing on this website, in any Dritiva deliverable, or in any communication from Dritiva constitutes medical advice, clinical diagnosis, treatment recommendation, or professional medical opinion for any individual patient or clinical situation.

Our clinical annotators and expert panel members provide structured human feedback and domain expertise in the context of AI training and evaluation tasks. Their contributions are professional inputs to AI model development — not clinical advice, medical opinions, or regulated clinical judgments applicable to real patients.

Healthcare AI products developed using Dritiva's services must be independently validated, regulated, and approved by the relevant authorities (FDA, CE, CDSCO, etc.) before clinical deployment. Dritiva's services do not replace, substitute for, or constitute any part of a regulated clinical trial, medical device evaluation, or regulatory submission process unless explicitly contracted under a specific ICH-GCP compliant study design.

2. No Regulatory Approval Guarantee

Dritiva makes no representation or warranty that the use of its services, deliverables, or annotation outputs will result in regulatory clearance, approval, or certification for any AI product, medical device, or Software as a Medical Device (SaMD) under any regulatory framework, including but not limited to:

  • US FDA 510(k), De Novo, or PMA pathways
  • EU MDR / IVDR CE Marking
  • India CDSCO Medical Device Rules 2017
  • UK MHRA approvals
  • Any other national or international regulatory framework

Clients are solely responsible for their regulatory strategy, submissions, and compliance. Dritiva recommends engaging qualified regulatory affairs professionals for all SaMD and medical device submissions.

3. Website Content Disclaimer

The content on www.dritiva.com is provided for general informational and commercial purposes only. While we make reasonable efforts to keep the information accurate and current, we make no warranties or representations — express or implied — about the completeness, accuracy, reliability, suitability, or availability of the information, products, services, or related graphics on the website.

Any reliance you place on such information is strictly at your own risk. Dritiva expressly disclaims all liability for any direct, indirect, incidental, or consequential loss or damage arising from the use of, or reliance on, the information on this website.

4. AI & Technology Disclaimer

Dritiva provides human feedback and evaluation services as inputs to AI model training and development. We are not responsible for:

  • The design, architecture, training decisions, or outputs of any AI model trained using our deliverables.
  • Any AI-generated content, clinical decision, or automated action taken by a model trained with our data.
  • Errors, hallucinations, or safety failures in AI systems deployed by our clients, regardless of whether our deliverables were used in their development.
  • Any harm to patients, users, or third parties arising from the deployment of AI products that incorporated our training data or evaluation outputs.

AI development is a multi-stage process involving many inputs. The quality of Dritiva's human feedback is one component — responsible AI deployment requires comprehensive testing, monitoring, and clinical governance by the AI developer and deploying organisation.

5. Third-Party Links

Our website may contain links to third-party websites for reference or informational purposes. These links do not constitute an endorsement by Dritiva of those websites, their content, or any products or services offered on them. Dritiva has no control over the content of external sites and accepts no liability for any loss or damage that may arise from your use of them.

6. Annotator Independence

Clinical annotators, physicians, and domain experts who provide feedback through Dritiva do so in their capacity as independent professional contributors to AI training tasks. Their annotations represent structured professional judgment for AI development purposes only. They are not acting as:

  • Treating physicians or clinical consultants to any patient;
  • Employees or agents of any client company for whom the annotation is performed;
  • Authors or endorsers of any AI system, model, or product.

7. Limitation of Liability

To the fullest extent permitted by law, Dritiva, its founders, officers, employees, and agents shall not be liable for any loss or damage arising out of or in connection with the use of this website or reliance on any information contained herein. This includes, without limitation, any direct, indirect, incidental, special, consequential, or punitive damages.

This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Dritiva has been advised of the possibility of such damages.

8. Jurisdiction

This Disclaimer is governed by the laws of India. Any disputes arising in connection with this Disclaimer shall be subject to the jurisdiction of courts in Mumbai, Maharashtra, India, subject to the arbitration provisions in our Terms & Conditions.
